On 12/29/07 the TN Commission of Indian
Affairs voted to repeal the rule, in an effort to receive an extension
on the statute authorizing the Commission of Indian Affairs.
Repeal was filed with
the Secretary of State 2/28/08, repeal effective 5/13/08.
The 2008-09 iteration of the TN Commission of Indian Affairs initiated
rule 0785-1 on
2/21/09, (RE: pg.
5 of
minutes -
IV. New Business, item 4). On 5/16/09 this same iteration
further supported implementation of
the rule
by initiating the
Aug. 8, 2009
Public Rule Making Hearing, (RE: pg. 1 of
minutes, item 3).
The new (2010) iteration of the TN
Commission of Indian Affairs approved the *identical rule on 1/23/10, (RE:
pg. 4 of
minutes).
Notification of
stay on Rule Chapter 0785-1
imposed by members of the Joint
Government Operations
Committee on 4/26/10.
The TN General Assembly's legislative body is comprised of 132
members, (33 senators and
99 representatives).
The
Joint Gov. Ops. Committee of 2010 was comprised of 22 members,
(9 senators and 13
representatives),
some committee members were not present to vote on 4/26/10.
The stay changed the rules effective date from 5/17/10 to 7/16/10,
sixteen days after the TCIA ceased to exist.
